These Terms & Conditions (“Terms”) govern your access to and use of www.wisecapitalmortgage.com (the “Site”), operated by Wise Capital Mortgage, LLC (“Wise Capital Mortgage,” “we,” “us,” or “our”), NMLS #2092335. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Not a Commitment to Lend

Nothing on this Site is an offer, commitment, or guarantee to extend credit or to lend on any particular terms. Rates, programs, loan amounts, down payment requirements and qualification criteria described on the Site are for general informational purposes, are subject to change without notice, and depend on factors including credit history, income, assets, debt, property type, occupancy, loan-to-value and market conditions. All loans are subject to credit approval, underwriting, appraisal and program guidelines. Actual terms will be provided in your official Loan Estimate and loan documents.

2. Informational Content Only

Articles, guides, calculators, examples and blog posts on the Site are provided for general education. They are not financial, legal, tax, investment or accounting advice, and they do not account for your specific circumstances. Consult a qualified professional before making financial decisions. Program details such as loan limits, income limits, credit thresholds and down payment assistance guidelines change frequently; always confirm current terms with a licensed loan officer.

3. Artificial Intelligence and Automated Tools

Parts of this Site, including calculators, content and customer communication tools, may be produced or assisted by artificial intelligence and other automated systems. Automated output can contain errors and is provided for general information only.

No calculator, chat response or other automated feature on this Site approves, denies, prices or conditions a loan, and none of it is an offer or a commitment to lend. Loan terms are determined by lenders and investors applying their own underwriting guidelines with review by licensed personnel. Always confirm figures with a licensed loan officer before relying on them.

4. Promotional Offers

Promotional offers referenced on the Site, including any appraisal reimbursement offer, are limited-time and limited-quantity promotions subject to eligibility requirements and to change or withdrawal at any time. Where an appraisal reimbursement is offered, it is issued as a credit at funding on a closed and funded loan through Wise Capital Mortgage, is limited to the stated number of new clients, cannot be combined with other offers unless expressly stated, and has no cash value if the loan does not close.

5. Your Submissions and Accuracy

When you submit a form, request a quote, or begin an application, you agree to provide accurate, current and complete information, and to promptly update it if it changes. Submitting false or misleading information in connection with a mortgage application may constitute fraud under federal and state law. You are responsible for maintaining the confidentiality of any credentials used to access our loan application portal.

6. Electronic Communications and Consent

By providing your contact information, you consent to receive communications from us electronically, by phone and by text, as described in our Privacy Policy. You agree that electronic communications satisfy any legal requirement that a communication be in writing. Consent to receive marketing calls or texts is not a condition of obtaining credit, and you may opt out at any time.

7. Third-Party Sites and Services

The Site links to third-party websites and services, including our online loan application portal and other tools we do not control. We are not responsible for the content, availability, accuracy, security or practices of any third-party service. Your use of a third-party service is governed by that provider’s own terms and privacy policy.

8. Intellectual Property

12. Limitation of Liability

To the fullest extent permitted by law, Wise Capital Mortgage and its members, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of the Site, whether based in contract, tort, strict liability or otherwise, even if advised of the possibility of such damages. Our total aggregate liability arising from your use of the Site will not exceed one hundred dollars ($100).

13. Indemnification

Wise Capital Mortgage, LLC, NMLS #2092335, is licensed in the State of Texas. Licensing information may be verified through the Nationwide Multistate Licensing System & Registry Consumer Access. Products and services described on the Site are available only where we are licensed to conduct business.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the jurisdiction of those courts.

17. Changes to These Terms

We may modify these Terms at any time. The revised version will be posted on this page with an updated “Last updated” date, and takes effect when posted. Your continued use of the Site after a change constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
