South Congress Mortgage Broker: Condo Loans, Warrantability and Small-Lot Homes

South Congress prices generally start above $1 million for houses, while condominiums along and just off the SoCo strip are the most common way to buy into the area for less.

A condo loan is two approvals, not one. The lender approves you, and separately approves the building. On South Congress, the building review is where deals stall — because the features that make SoCo condos appealing are often the same ones that make a building harder to finance.

Warrantable and non-warrantable, explained

A warrantable condo is in a project that meets Fannie Mae or Freddie Mac standards, so the loan can be sold to them. Warrantable buildings get standard conventional pricing and down payments.

A non-warrantable condo is in a project that fails one or more of those standards. It can still be financed, but only by lenders who keep such loans or place them with private investors — usually with a larger down payment and higher pricing.

The building's status is not always in the listing. It comes from a condo questionnaire the association completes for the lender, and it is worth requesting during the option period.

The SoCo features that trigger non-warrantable status

Ground-floor retail. Mixed-use buildings with shops and restaurants at street level are standard along Congress. Agency guidelines cap the share of a project that can be commercial space; buildings above the cap are non-warrantable.

Short-term rental activity. A building that operates like a hotel — a rental desk, a rental pool, daily or weekly stays, units that must be placed in a management program — is treated as a condotel and is not warrantable.

Investor concentration in newer projects. When one entity, often the developer, still owns a large share of the units, the project can fail the single-entity ownership limit until more units sell.

Pending litigation. Construction-defect suits against the developer are common in the first years of a building's life and can make the project ineligible until resolved.

Thin reserves or delinquent dues. Associations must budget for reserves and keep delinquencies below a set level. A building with a special assessment in progress deserves a close look.

Short-term rental plans

Many SoCo buyers assume they can rent the unit by the night. Two layers decide whether that is true:

The City of Austin licenses short-term rentals and restricts non-owner-occupied rentals in many zones. Its rules have changed several times, so confirm the current ones for the specific address.

The association's declaration frequently prohibits short-term rentals outright, or sets a minimum lease term.

Do not count short-term rental income to qualify unless both layers allow it and the program you are using accepts it. For an investor buying on projected rental cash flow, a DSCR loan is usually the right tool — and it still depends on the building allowing the rentals.

Small-lot houses off the strip

West of Congress, in the Bouldin Creek area, and east toward Travis Heights, SoCo's houses sit on small lots with older stock and frequent rebuilds.

Two homes on one lot are common, and many are held as condominium regimes rather than as a duplex. Those are financed as condos, though small regimes of two to four units are generally exempt from the full project review described above. Our East Austin page covers that structure.

Taxes on South Congress

A SoCo address inside the City of Austin carries the City of Austin, Travis County, Austin ISD, Austin Community College and Central Health rates — generally around 1.8% to 2.1% of assessed value combined.

Condo dues are separate from taxes, and on buildings with amenities, elevators and retail space they can be a large part of the monthly cost. Lenders count them in your debt-to-income ratio, so get the current dues and any pending assessments before you set a budget.

Where people buy

The strip itself, along Congress Avenue from the river toward Oltorf, is where mixed-use and mid-rise condominium buildings concentrate.

Bouldin Creek, west of Congress, carries small-lot cottages, bungalows and two-home regimes on narrow streets.

The blocks east of Congress meet the hills of Travis Heights and shift toward larger lots and older houses.

Toward Lady Bird Lake, the northern end of the strip holds the tallest buildings and the most direct walk across the Congress Avenue Bridge to downtown.

The neighborhood

South Congress Avenue runs south from the Congress Avenue Bridge with an unbroken view of the Texas State Capitol behind it, and its shops, restaurants and music venues have made it one of Austin's most visited streets.

The Continental Club, open since the 1950s, anchors its live music. The Hotel San José, a restored 1930s motor court, set the pattern for the boutique hotels that followed. The Congress Avenue Bridge is also home to the largest urban bat colony in North America, which emerges at dusk through the warm months.
